Appeals

IRS Tax Appeal Services

If you believe your rights have been infringed in any manner or you disagree with the IRS determination in your case, you have the right as a taxpayer to appeal that decision. Having a tax attorney on your side is the best approach to fixing your tax problem.

The IRS appeals process may be confusing, particularly for those who have never filed an appeal before and are unfamiliar with how it works. The appeals process takes time and skill. Wolf Tax will give you the support, protection, and confidence you need going into your IRS tax appeal case with a tax attorney that will aggressively fight for you. We have handled hundreds of IRS appeals and can assist you in getting the results you deserve.

Your Right to Appeal the IRS Decision

The IRS provides fundamental rights that the IRS must adhere to when it comes to taxpayers. This is called the Taxpayer Bill of Rights. These range from the right to be informed; the right to pay no more than the correct amount of tax; the right to finality; the right to retain representation, such as a tax attorney; and more. To learn more about these in detail, click here. However, the rights we are concerned most about are the right to challenge the IRS's position and be heard and the right to appeal an IRS decision in an independent forum.

If you do not agree with an IRS determination, you have the right to appeal the decision, and then that decision will be heard by an independent office of the IRS. However, you must respond promptly when it comes to appeals.

  • For math or clerical errors, you have 60 days to tell the IRS you disagree.
  • If you receive a tax adjustment (known as a statutory notice of deficiency, form CP3219A), you have the right to challenge the adjustment in a United States Tax Court before paying it. You need to file this 90 days from the date of the notice.
  • When the IRS notifies you of plans to levy your bank account or other property, you have the right to request a hearing before the Office of Appeals.
